    A vaper recently was cited for vaping on a subway platform in New York, and he went to court. Dubbed “People vs. Thomas,” the court decided that the definition, which defines smoking as “the burning of a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco,” did not include vaping. While smoking is banned in many public areas in New York, the judge ruled that wouldn’t necessarily mean vaping.

    ChurnMag.com reported that the court previously had said that an e-cig “neither burns nor contains tobacco. The courts of New York have yet to make a determination as to whether electronic cigarettes are to be viewed any differently under these sections than tobacco cigarettes.”

    The judge ruled that e-cigs “do not match up with the state’s current definition of smoking and cannot be treated as tobacco products if they contain no tobacco.” New York City current groups in vaping bans with the Smoke Free Air Act, but the entire state hasn’t yet ruled on the matter.
