A Response to the DOH of the State of New York

Look, for whatever reason you come up with, no matter how far fetched or preposterous, we see right through it. Smoking in a stairwell could not possibly start a fire in a stairwell. Not by smoking 100’s of cigarettes non stop for days on end. A stairwell is concrete and steel. But it was based on that implausible farce that the first domino fell. No smoking in stairwells, then no smoking in front of a doorway, then 50 feet of a doorway and so on all the way towards the complete imposition of your will - a ban smoking outright.

Maybe your intent was just but how did you go about achieving your goals? By stating a complete falsehood as fact. By being disingenuous. By manipulating the law and bending it out of shape. A cigarette is capable of creating a fire in an empty space surrounded by concrete and steel. Who were you kidding then? No one. But is served your needs. Who are you kidding now?

We ought to say no to the alteration of reality to serve a minority group’s agenda. A flavored vegetable glycerin and nicotine solution cannot be “deemed” to be tobacco. Just the same way a government agency cannot wave a magic wand, deem a thing that is not a thing from then on to now be a thing that it has authority over for the express purpose of imposing its authority over it.

This kind of power grab is offensive to our system of laws based on fact and truth. It is an overstep of authority and ought to be checked full stop.

Now we have a new absurdity. Make all flavors disappear so that everything tastes in the way that a group of people who have no business dictating such things to anyone decides how things ought to taste for everyone.

Only this time your position is not only completely off base but it is HARMFUL. It serves no benefit to any part of the public. Fact based, peer reviewed studies prove this and ignoring these and other data is irresponsible to the point of, frankly, criminal negligence. (Cite reference to studies that clearly demonstrate this law is ineffective at getting kids to not want the delicious thing that grow ups tell them is forbidden - here)

If this is about lost revenue for the state, then say so. Let’s focus on and attempt to resolve that issue, if that is the real issue. Why the song and dance? Taking the flavor from our mouths is not your job. It has nothing to do with kids. If it were -then CONTROL YOUR KIDS.
If this were about our health ... there is no point to go through these arguments.

There is no normalizing smoking but there is normalizing the erosion of personal liberties. Systematic removal of privacy and increasing instances where our business which ought to be rightfully our business has been made your business. And unwelcome, on false pretenses, threatening and disruptive to our business, once again - here you are.

How would you like it if someone came to your house next Saturday morning and smacked the bagel out of your mouth citing the morbid amount of sugar you consume in that horrible industrialized swill you call jelly?

That person would be right — you shouldn't eat that. It is really bad for you. But you enjoy it. Not on our watch you don’t! What if that person stayed in your house all day following you around telling you what to do? Sound good?

What if the behavior of ours you have made it your job to change is actually BENEFICIAL TO US? Maybe we should start force feeding you sugar?

It is time to ask yourselves:

DID YOU DREAM OF BECOMING LAW MAKERS SO YOU COULD BETRAY THE FUNDAMENTAL SPIRIT OF SELF DETERMINATION AND LIBERTY OUR COUNTRY WAS FOUNDED ON?

Are you so limited in intelligence and ingenuity that the only way to achieve your political objectives you have to use deception, falsehood, fear mongering, scapegoating and other forms of underhanded manipulation? You ignore facts, disrespect the intelligence of your community and tread on our basic right to be left alone.

DO YOU THINK YOU CAN CONTINUE ON YOUR CRUSADE TO RUIN ANOTHER PORTION OF POSSIBLY THE ONLY REMAINING PLEASURE SOME OF US HAVE LEFT AND WE WONT VOTE YOU OUT?

DO YOU THINK IF WE CAN BUILD A CASE FOR CRIMINAL MISCONDUCT BY INTERFERING WITH OUR OTHERWISE SUCCESSFUL SMOKING CESSATION PROGRESS THAT WE WON’T?

If this is really about your concern for your children, THEN DISCIPLINE YOUR CHILDREN.

What kind of backwards lazy sub-genius came up with the plan to curtail the rights of other adults who have nothing to do with your rotten kids as a solution to a problem that does not exist and really serves only to compensate for your failures at parenting anyhow?

This law as proposed is a proclamation of your failings. And your failings hurt others.

STOP IT, PLEASE.

New York state DOH is trying to ban vape completely.
What you need to know:

1). Hours after our November 6th election a bill was proposed to ban E-liquid flavors completely only leaving tobacco flavored E-liquid. 96% of the vapor industry IS flavors, this could be LAW Jan 1st 2019. (Yes about a month and a half).

2). We have 60 days from November 7th to call and email them and tell them not to ban flavors and tell them how flavors saved you from cigarettes and the cancer and death that comes with traditional smoking.

3). Although we have 60 days to make public comment, that 60 days falls on Jan 5th 2019, and if it goes through it would have already been banned by then, given the weekend at the end of December. Friday, December 28 2018 will be the last day to comment(E-mail/phone call) this puts us at a window of 51 days and as it stands on the date of this email we now have 46 days. (times ticking).

4). This bill would make it illegal to possess ANY flavored E-liquid. The bill was redacted quickly because it was rendered illegal and in some opinions unconstitutional. The same bill is being written up as we speak with slightly different wording so it does not seem like the NYS DOH is in violation of your rights. Same bill same public comment period. we need to call and email and we all need to get our friends and family to call and email as well.
